Terms of Service
In plain words: Ayurathma is a telemedicine platform operated by 3Phala Ayurcentre Private Limited. Doctors on our platform are qualified Ayurvedic practitioners licensed in India. Consultations follow the Telemedicine Practice Guidelines, 2020. Ayurvedic medicine is complementary to, not a replacement for, emergency or life-saving allopathic care.
1. About these terms
These Terms of Service ("Terms") are a legal agreement between you and 3Phala Ayurcentre Private Limited, CIN U74999TN2018PTC125961, having its registered office at New No.19, Old No.61, 27th Street, L-Block, Anna Nagar East, Chennai - 600 102, Tamil Nadu, India ("Ayurathma", "we", "us", "our").
By creating an account, booking a consultation, listing yourself as a doctor, or otherwise using ayurathma.com and its patient, doctor, and admin sub-domains (together, the "Platform"), you accept these Terms. If you do not accept these Terms, please do not use the Platform.
2. What Ayurathma provides
Ayurathma is an online technology platform that connects patients seeking Ayurvedic consultation with qualified Ayurvedic Registered Medical Practitioners ("RMPs") in India. Through the Platform we facilitate:
- Discovery, booking, and payment for teleconsultations
- Text (chat) consultations conducted by the RMP; video or audio consultation may be offered in future
- E-prescriptions issued by the RMP in accordance with the Telemedicine Practice Guidelines, 2020 and the National Commission for Indian System of Medicine Act, 2020 (NCISM)
- Fulfilment of prescribed Ayurvedic medicines through our sister platform Ayurkart (ayurkart.com), also operated by 3Phala Ayurcentre Private Limited
- Storage of your consultation history and prescriptions in your patient account
Ayurathma is not itself a hospital, clinic, or medical practitioner. The doctor-patient relationship is established directly between you and the treating RMP. Ayurathma is a technology intermediary as defined under the Information Technology Act, 2000.
3. Eligibility
- You must be at least 18 years old to open an account. A parent or lawful guardian may book on behalf of a minor and is responsible for supervising the consultation
- You must be located in India at the time of consultation. Ayurathma is designed for the Indian market
- Doctors listed on the Platform must be qualified BAMS practitioners registered with a State Board/Council of Indian Medicine (under the NCISM), holding a valid registration number
- You must provide accurate registration and health information. Providing false information may result in immediate suspension of your account
4. Telemedicine consultation — how it works
4.1 Booking
You may browse doctors by specialty, availability, and consultation fee, and book an appointment through the patient portal. Booking is confirmed only after successful payment and generation of a booking reference.
4.2 The consultation
Consultations are conducted as secure text (chat) sessions in your patient portal. The RMP will collect your history, assess you as far as is possible over text and any images or prior reports you upload, and — where clinically appropriate — issue an e-prescription. The consultation and the prescription are governed by the applicable Telemedicine Practice Guidelines, 2020.
4.3 Identity verification
At the start of every consultation the RMP will verify your identity. If we cannot verify identity, the consultation will not proceed and will be refunded per the Refund Policy.
4.4 Records
Consultation notes and prescriptions are stored in your patient account and are available for at least 3 years, per the Telemedicine Practice Guidelines. You may download them at any time. Video calls are not recorded by Ayurathma.
Not for emergencies. Ayurathma teleconsultation is not a substitute for emergency care. In case of medical emergency — chest pain, breathlessness, severe bleeding, loss of consciousness, poisoning, high-grade fever with confusion, stroke or heart attack symptoms — call 112 or go to the nearest hospital emergency room immediately.
5. Medicines and prescriptions
- Only medicines that fall within the Ayurvedic pharmacopoeia and are legally saleable under the Drugs and Cosmetics Act, 1940 and its Rules may be prescribed on Ayurathma
- The RMP is solely responsible for the appropriateness of any medicine prescribed. Ayurathma does not select, modify, or dispense medicines
- You may choose to order the prescribed medicines through Ayurkart (which operates a licensed sale under the Drugs and Cosmetics Rules) or through any other licensed pharmacy of your choice
- Certain classes of drugs (Schedule H, H1, X under the Drugs and Cosmetics Rules) will not be prescribed via teleconsultation, in line with the Telemedicine Practice Guidelines
6. Doctor obligations
Doctors ("RMPs") using the Platform agree to:
- Maintain a valid registration with an Indian State Board/Council of Indian Medicine (under the NCISM) throughout their listing period, and complete Continued Medical Education as required
- Follow the Telemedicine Practice Guidelines, 2020 and the professional code of ethics of the NCISM
- Verify patient identity, document consultations, and issue e-prescriptions bearing their signature and registration number
- Not prescribe outside their specialty or beyond what is safe over teleconsultation
- Maintain patient confidentiality and comply with our Privacy Policy
- Accept payouts as agreed. Ayurathma retains a platform fee, disclosed at the time of listing
7. Payments
- All fees are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise
- Payments are processed by Razorpay Software Private Limited. Ayurathma does not store card, UPI, or bank account details
- An invoice is issued to your email after successful payment
- Refunds are governed by our Refund and Cancellation Policy
8. Acceptable use
You agree not to:
- Use the Platform for anything other than seeking or providing Ayurvedic consultation and related services
- Impersonate another person or provide false identity or medical information
- Record, screenshot, screen-share, or redistribute a consultation without the other party's written consent
- Attempt to reverse-engineer, probe, or interfere with the Platform's security
- Solicit doctors off-platform to avoid platform fees
- Upload malware or unlawful content
- Use the Platform to promote or sell any product or service without written permission
9. Intellectual property
All content on Ayurathma — logos, design, text, code, images, videos — is owned by 3Phala Ayurcentre Private Limited or licensed to us. You may not copy, reproduce, distribute, or create derivative works without prior written permission. You retain ownership of your own health data; you grant us a licence to process it for the purposes described in our Privacy Policy.
10. Limitation of liability
Ayurathma acts as a technology intermediary. To the maximum extent permitted by Indian law:
- Ayurathma is not liable for the clinical advice given by an RMP. The RMP is independently responsible for the standard of care
- Ayurathma is not liable for delays or failures caused by internet connectivity, third-party providers (payment gateway, video, hosting), or force majeure events
- Our total liability to any single user in any consecutive twelve-month period will not exceed the total fees paid by that user to Ayurathma in that period, capped at INR 25,000, whichever is higher
Nothing in these Terms excludes liability that cannot be excluded by law, including liability for gross negligence or wilful misconduct.
11. Indemnity
You agree to indemnify Ayurathma and 3Phala Ayurcentre Private Limited against any loss or claim arising out of your breach of these Terms, your misuse of the Platform, or your infringement of any third-party right.
12. Suspension and termination
We may suspend or terminate your access to the Platform, without prior notice, if:
- You breach these Terms
- We are required to do so by law or a regulator
- We reasonably believe your account is being used for fraud, illegal activity, or endangerment of another user
You may close your account at any time by writing to the Grievance Officer. On closure, we will retain records as required by law (see Privacy Policy).
13. Modifications
We may update these Terms from time to time. Material changes will be notified by email and via a notice on the Platform. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.

15. Governing law and jurisdiction
These Terms are governed by the laws of India. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Chennai, Tamil Nadu.
